General Terms and Conditions

1. Definitions

In these General Terms and Conditions, the following terms shall have the following meanings:

• For-Motion: For-Motion B.V., located at Sprengenweg 10, 8181 NN Heerde, the Netherlands, Chamber of Commerce number 84900180, VAT no. NL 004 041 431 B60.
• Website: the e-commerce brand page of For-Motion, accessible via https://for-motion.nl.
• Customer: the natural or legal person who places an order via the Website.
• Agreement: any order and the related mutual rights and obligations between For-Motion and the Customer.
• Products: the goods offered by For-Motion and ordered by the Customer.

2. Applicability

These General Terms and Conditions apply to every offer, every order, and every Agreement between For-Motion and the Customer for the delivery of Products via the Website, unless expressly agreed otherwise in writing.

3. Offer and conclusion of agreement

3.1. Information regarding Products included on the Website is an invitation to place an order, not an offer. 3.2. An Agreement is concluded at the moment For-Motion confirms the order placed by the Customer via email.

4. Prices and payment

4.1. The prices stated on the Website are in euros and include VAT, excluding shipping costs, unless stated otherwise. 4.2. Payment can be made via the payment methods offered on the Website. For-Motion reserves the right to refuse orders in case of payment refusal or payment risk.

5. Delivery

5.1. For-Motion aims to deliver orders within 2-5 working days after confirmation. 5.2. Delivery takes place at the delivery address specified by the Customer in the Netherlands. 5.3. The risk of loss or damage to Products passes to the Customer from the moment of delivery.

6. Right of withdrawal

6.1. Consumers have the right to return a Product purchased in the webshop within 14 days of receipt without giving reasons. 6.2. The withdrawal period expires 14 days after the day on which the Customer receives the Product. 6.3. To exercise this right, the Customer must inform For-Motion within the period via info@for-motion.nl and return the Product in its original condition, packaging, and complete.

7. Exclusion of right of withdrawal

The right of withdrawal is excluded for custom-made, printed, or perishable products, and products that are not suitable for return for hygiene reasons if the seal has been broken.

8. Costs in case of withdrawal

If the Customer exercises their right of withdrawal, only the original shipping costs shall be for their account, unless For-Motion has indicated otherwise.

9. Warranty and conformity

9.1. For-Motion guarantees that the delivered Products comply with the agreement, the specifications on the Website, and reasonable requirements of soundness. 9.2. Damage due to improper use, wear and tear, or intent/personal fault is not covered by the warranty. 9.3. Warranty claims must be reported within 2 months of discovering the defect via info@for-motion.nl.

10. Liability

10.1. For-Motion is only liable for direct damage and never for consequential or indirect damage. 10.2. Maximum liability is limited to the invoice amount of the relevant order. 10.3. This limitation does not apply in the case of intent or gross negligence by For-Motion.

11. Intellectual property

All intellectual property rights to the Website, the Product descriptions, images, and documentation belong to For-Motion or its licensors. Nothing from these terms and conditions may be reproduced or made public without written permission.

12. Privacy

For the processing of the Customer's personal data, please refer to our Privacy Policy, which can be found at https://for-motion.nl/privacy.

13. Changes to General Terms and Conditions

For-Motion reserves the right to change these General Terms and Conditions. Changes will be published on the Website with the date of entry into force.

14. Applicable law and disputes

Dutch law applies to all Agreements. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law prescribes another court.

15. Complaints procedure

In case of complaints, a consumer should first contact the entrepreneur. If the webshop is affiliated with WebwinkelKeur and in the case of complaints that cannot be resolved in mutual consultation, the consumer should contact WebwinkelKeur (www.webwinkelkeur.nl), which will mediate for free. Check if this webshop has an active membership via https://www.webwinkelkeur.nl/leden/. If a solution is still not reached, the consumer has the option to have their complaint handled by the independent disputes committee appointed by WebwinkelKeur; its decision is binding, and both the entrepreneur and the consumer agree to this binding decision. There are costs associated with submitting a dispute to this disputes committee, which must be paid by the consumer to the relevant committee.
