Terms & Conditions

1. Definitions

In these Terms & Conditions, the following terms shall have the following meanings:

For-Motion: For-Motion B.V., Sprengenweg 10, 8181 NN Heerde, The Netherlands, Chamber of Commerce No. 84900180, VAT No. NL004041431.
Website: The e-commerce brand website of For-Motion, accessible at https://for-motion.nl.
Customer: The natural or legal person who places an order via the Website.
Agreement: Any order and the corresponding mutual rights and obligations between For-Motion and the Customer.
Products: The goods offered by For-Motion and ordered by the Customer.

2. Applicability

These Terms & Conditions apply to every offer, order and Agreement between For-Motion and the Customer for the delivery of Products via the Website, unless expressly agreed otherwise in writing.

3. Offer and formation of agreement

3.1. The information on the Website about Products is an invitation to place an order, not an offer.
3.2. An Agreement is formed when For-Motion confirms the order placed by the Customer by email.

4. Prices and payment

4.1. The prices stated on the Website are in euros and include VAT, excluding shipping costs, unless otherwise stated.
4.2. Payment can be made via the payment methods offered on the Website. For-Motion reserves the right to refuse orders in case of payment refusal or risk.

5. Delivery

5.1. For-Motion strives to deliver orders within 2-5 working days after confirmation.
5.2. Delivery takes place at the delivery address specified by the Customer in the Netherlands.
5.3. Risk of loss or damage to Products passes to the Customer from the moment of delivery.

6. Right of withdrawal

6.1. Consumers have the right to return a Product purchased in the webshop within 14 days after receipt without giving reasons.
6.2. The withdrawal period expires 14 days after the day the Customer receives the Product.
6.3. To exercise this right, the Customer must inform For-Motion within the period via info@for-motion.nl and return the Product in original condition, packaging and complete.

7. Exclusion of withdrawal right

The right of withdrawal is excluded for custom-made, printed or quickly perishable products, and products that are not suitable for return for hygienic reasons if the seal has been broken.

8. Costs of withdrawal

If the Customer exercises their right of withdrawal, only the original shipping costs are at their expense, unless For-Motion has indicated otherwise.

9. Warranty and conformity

9.1. For-Motion guarantees that the delivered Products comply with the agreement, the specifications on the Website and the reasonable requirements of soundness.
9.2. Damage due to improper use, wear or intent/own defect is not covered by the warranty.
9.3. Warranty claims must be reported within 2 months after discovery of the defect via info@for-motion.nl.

10. Liability

10.1. For-Motion is only liable for direct damage and never for consequential or indirect damage.
10.2. Maximum liability is limited to the invoice amount of the relevant order.
10.3. This limitation does not apply in case of intent or gross negligence by For-Motion.

11. Intellectual property

All intellectual property rights to the Website, Product descriptions, images and documentation belong to For-Motion or its licensors. Nothing from these terms may be reproduced or disclosed without written permission.

12. Privacy

For the processing of personal data of the Customer, we refer to our Privacy Policy, which can be found at https://for-motion.nl/privacy.

13. Amendment of Terms & Conditions

For-Motion reserves the right to amend these Terms & Conditions. Changes will be published on the Website with indication of the effective date.

14. Applicable law and disputes

Dutch law applies to all Agreements. Disputes will be submitted to the competent court in the Netherlands, unless mandatory law designates another court.
